Who we are

iNRECO Ad Studio is a tool that helps you create advertising pictures and captions for your business. It is operated by Casper Badenhorst, trading as iNRECO Consulting, a sole proprietor based at 902, 29th Avenue, Rietfontein, Pretoria, 0084, South Africa. Contact: info@inreco.co.za. By making an account you agree to these terms.

Eligibility

You must be 18 or older, and legally able to enter into a contract, to use this service.

Your account

You must give correct details when you sign up and keep your password private. You are responsible for everything done on your account. One account is for one business unless your plan says it includes more team members.

What you may create

You may not use the tool to make adverts that are illegal, hateful, misleading, adult in nature, or that copy someone else's brand.

You are responsible for checking that every advert you publish is truthful and follows the advertising rules where you live, including the codes of the Advertising Regulatory Board (South Africa) where applicable.

Who owns the adverts

The pictures and captions you create are yours to use commercially, including on social media, in print and in paid advertising.

You keep ownership of your logos, brand names and anything else you upload. You give us permission to store and process them only so the tool can work. The software and platform itself remain our property.

Paying for the service

Prices are shown in South African Rand and are charged through PayFast. Monthly and yearly plans renew automatically until you cancel. Each plan includes a set number of images per period. Unused plan images do not carry over. Top-up image packs never expire.

In line with the Consumer Protection Act, you may cancel any ongoing plan at any time; we will not charge a penalty beyond the value of what you've already used, and we will not automatically lock you into a renewal without reasonable prior notice where the law requires it.

Availability

We work hard to keep the tool running but we cannot promise it will never be unavailable. Picture and caption creation depends on other companies' services, which can be slow or unavailable at times.

Ending your account

You can cancel at any time from the billing page and you keep access until the end of the period you paid for. We may suspend an account that breaks these terms or that is used to attack or abuse the service.

Limits on our responsibility

The tool is provided as it is. To the fullest extent the law allows, our total responsibility to you is limited to what you paid us in the previous three months. Nothing in these terms limits our liability for gross negligence, wilful misconduct, fraud, or any other liability which cannot lawfully be excluded or limited under South African law.

These terms don't override your rights

Nothing in these terms limits any right you have under the Consumer Protection Act, POPIA, or any other law that cannot be excluded by agreement.

Governing law

These terms are governed by the laws of South Africa, and any dispute will be subject to the jurisdiction of the South African courts.

Changes to these terms

We may update these terms from time to time. Continued use of the tool after a change means you accept the updated terms.
